By availing any service from Comstear (“the Agency”), the client (“the Client”) acknowledges, understands, and agrees to the Terms & Conditions outlined below.
1. Definition of Terms
- “Comstear” / “Agency” — The service provider responsible for web design, development, and creative services.
- “Client” — The individual or business purchasing services.
- “Project” — Any task, development, or creative work requested and agreed upon.
- “Deliverables” — Files, outputs, and completed work included in the agreed scope.
- “Contract/Agreement” — Signed proposal, chat confirmation, digital invoice, or message confirming acceptance.
2. Acceptance of Terms
By paying the down payment, joining the official consultation meeting, or submitting requirements, the Client automatically agrees to all policies and terms set by Comstear.
These Terms apply to all packages, custom work, revisions, and service engagements.
3. Service Scope
Comstear provides:
- Website design & development
- UI/UX design
- Creative production
- Hosting setup assistance (if included)
Not included unless stated: Content writing, photography, domain purchase, hosting subscription, third-party platform payments.
Any additional feature requested outside the original agreement is subject to separate billing.
4. Payment Terms
4.1 Down Payment
- Required for project activation.
- Strictly non-refundable under all circumstances.
4.2 Milestone Payments
Milestone payments must be settled exactly on the agreed schedule. Late payments result in automatic work suspension and timeline extension.
4.3 Final Payment
All balances must be settled before deployment, file release, or server upload. No exceptions.
5. Client Responsibilities
- Provide accurate information, logo files, texts, and credentials.
- Respond within 48 hours.
- Submit complete requirements.
- Respect official communication hours.
- Review and approve drafts promptly.
- Provide consolidated revision lists (no scattered messages).
- Follow Comstear’s workflow and processes.
Delays from the Client automatically pause the project timeline.
6. Agency Responsibilities
- Deliver quality work aligned with the approved design and scope.
- Provide timely updates.
- Inform the Client of delays when necessary.
- Maintain professionalism and clarity.
- Ensure proper testing before launch.
7. Revision Terms
- Revisions are limited per package (2, 3, 5 rounds depending on tier).
- All requests must be compiled in one list.
- New features or redesigns are not revisions.
- Extra revisions = additional charges.
- Revision freeze may occur during backend or optimization phases.
8. Project Timeline & Delays
8.1 Agency-Caused Delays
- Technical issues
- Power/network outages
- Health/emergency cases
8.2 Client-Caused Delays
- No response for more than 48 hours
- Late approvals
- Incomplete requirements
- Sudden direction changes
- Contradicting instructions
Frozen timelines resume only once the Client responds.
9. Termination Clause
Comstear reserves the right to pause or terminate the project if the Client shows disrespect, toxic behavior, micromanagement, policy violations, failure to pay, ghosting, bargaining after agreement, abuse, or harassment.
All payments made will be forfeited upon termination.
10. Intellectual Property Rights
- Before full payment — all assets belong to Comstear.
- After full payment — rights are transferred to the Client.
- Comstear may feature the project in its portfolio unless otherwise requested.
11. Warranty & Support
Warranty duration:
- Basic: 7 days
- Standard: 14 days
- Pro: 30 days
Covers minor bugs and small fixes only. After warranty, all requests are paid services.
12. Third-Party Tools & Hosting
Comstear is not liable for issues caused by hosting downtime, domain errors, third-party plugins, or platform updates.
13. Modifications to Terms
Comstear may modify these Terms at any time. Updates take effect immediately upon publication.
14. Agreement Confirmation
By availing Comstear’s services, the Client confirms that they have read, understood, and agreed to all sections. Violations may lead to project suspension or termination.
